This Privacy Policy ("Policy") describes ULMA Form-Works, Inc. ("ULMA," "our," "we," or "us") practices with respect to personal information collected in connection with ULMA’s online platform, myULMA (the "Platform") which allows users to access and upload information (including text, picture, audio, and video format) relating to ULMA equipment and services.

This Policy applies to all persons who access or use the Platform. If you do not agree to the practices described in this Policy, do not access or use the Platform.

We reserve the right to modify this Policy from time to time. In such cases, we will provide notice through the Platform and/or other means.

PERSONAL INFORMATION WE COLLECT

INFORMATION THAT YOU AFFIRMATIVELY PROVIDE

The Platform may allow you to provide information, including personal information, to ULMA. By personal information, we generally mean information that directly identifies you, such as your name or email address. By uploading or otherwise submitting information to the Platform you indicate that you agree to the terms of this Policy.

When you provide us with your email we may, subject to applicable law, use your email address to send you Platform-related notices (including any notices required by law, in lieu of communication by postal mail), updates, news, and marketing messages. If the Platform is temporarily unavailable, we may also send you an email.

Email communications you receive from us will generally provide an unsubscribe link or instructions allowing you to opt out of receiving future emails or to change your contact preferences. Please remember that even if you opt out of receiving marketing emails, we may still send you important Platform-related information. If you correspond with us by email, we may retain the content of your email messages, your email address, and our responses.

You should not submit any sensitive personal information through the Platform. We cannot guarantee that sensitive personal information will be maintained confidentially or securely. You also should not submit information about other individuals unless you have permission to do so.

You agree that information that you submit to the Platform is truthful, exact, complete and current, and you accept liability for any damage or harm, direct or indirect, that may arise as a result of non-compliance with this obligation. In the event that the information provided belongs to a third party, you represent and warrant that the third party has been informed about the terms of this Policy and that you have obtained authorization to provide such personal information to us for the aforementioned purposes.

WHAT WE DO WITH PERSONAL INFORMATION

We use, disclose, transmit, provide access to, process, and store information and personal information for purposes, including the following to:

  • send out surveys to users in order to offer and/or improve our services (your response is voluntary);
  • communicate with you about our products and services, and products and services that we believe may be of interest to you;
  • respond to your requests and inquiries, or to fulfill any purpose for which you provide it;

We also may use third party service providers or business partners to provide any of the activities that we may provide under this Policy. It is not possible to describe every potential use, disclosure, transmission, access, processing, or storage of information and personal information, and we reserve the right to engage in any other lawful activity with respect to such information and personal information without notice to you.

Other than as described in this Policy, in general personal information is not shared with third parties for third party commercial purposes, other than to our affiliates and business partners. DATA SECURITY

We have taken commercially reasonable measures to protect personal information that is provided through the Platform. Our data security systems are maintained in accordance with good business practices. Nevertheless, no transmission of information is perfectly secure, and we cannot ensure that the measures we have taken will be sufficient to protect your personal information. In addition, the measures we have taken are not designed for sensitive personal information, so please do not submit such information through the Platform.

STATE USER RIGHTS

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

To exercise any of these rights please email us at info@ulmaconstruction.us. To appeal a decision regarding a consumer rights request, you must reply to our written denial of any request previously made to us via email within 45 days of your receipt of the written denial. We will, within 60 days of receiving your appeal request, provide you with any action taken or not taken in response to your appeal, including a written explanation of our reasons for the decisions. If we deny your appeal, you will be provided with additional information regarding your rights under applicable law.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: info@ulmaconstruction.us. However, please know we do not currently sell data triggering that statute's opt-out requirements.

CALIFORNIA USER RIGHTS

Your Right to Know and Delete

You have the right to request that we disclose certain information to you about our collection and use of your personal data over the past 12 months. Once we receive and validate your request, we will include a list of your personal data that may have been disclosed and the categories of third parties the information may have been disclosed to.

You may request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request. We may deny your deletion request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies.

If your request is approved, we will delete or deidentify the relevant information and will direct our service providers to take similar action.

Exercising Your Rights to Know, Delete or Correct

To exercise your rights to know or delete described above, please submit a request by either: calling us at (+1) (201) 882-1122 or emailing us at info@ulmaconstruction.us. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal data. You may only submit a request to know twice within a 12-month period. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt, unless we require an extension. If we reasonably require an extension we will inform you of the reason and extension period.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA/CPRA rights. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

California’s Shine the Light Law

California Civil Code Section 1798.83 permits users of our Platform that are California residents to request certain information regarding our disclosure of the information you provide through the Platform to third parties for their direct marketing purposes.
